Daywild offers ideas for ordinary, real-life activities. You remain in charge of where you go, what you do, and whether a mission is appropriate for you.

1. Agreement to these Terms

These Terms of Use (“Terms”) govern access to the Daywild mobile app, website, API, content, and related services (collectively, the “Service”), independently published by Gautam (“Daywild,” “we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Daywild. If the law where you live requires a higher age for you to agree to online terms or provide data, you may use Daywild only with authorization and supervision from a parent or legal guardian. You represent that you are legally able to agree to these Terms.

3. What Daywild provides

Daywild matches context choices—time, energy, social mode, and budget—to a bank of human-curated real-life missions. It may provide a timer, one reroll, completion proof, reflection, a shareable card, history, and statistics. Features may vary by platform, region, release, connectivity, or availability.

Daywild v1 has no account, subscription, advertising, public feed, or social graph. This may change only with updated product disclosures and terms.

4. Mission safety and personal responsibility

Your safety overrides every mission. Skip or stop any mission that feels unsafe, unlawful, inappropriate, inaccessible, or beyond your ability. A mission is always optional.

You are solely responsible for evaluating your circumstances, including weather, traffic, terrain, health, fitness, accessibility, local rules, property boundaries, opening hours, transportation, costs, the people around you, and any other real-world risk. When using Daywild:

  • obey all laws, signs, venue rules, and instructions from authorities or property owners;
  • do not trespass, enter restricted areas, distract yourself while driving, or use Daywild in a way that endangers anyone;
  • stay aware of traffic, surroundings, personal belongings, and emergency conditions;
  • do not photograph, record, approach, or share information about another person without appropriate respect and permission;
  • use suitable supervision and reasonable precautions for physical activity, travel, food, public interaction, and unfamiliar locations;
  • do not undertake a mission under the influence of anything that impairs judgment; and
  • contact local emergency services—not Daywild—when urgent help is needed.

Daywild does not verify that a location, venue, route, person, product, food, transport option, or activity is safe, open, lawful, accessible, or suitable.

5. Not medical, fitness, professional, or emergency advice

The Service is for general lifestyle and entertainment purposes. It is not medical, mental-health, fitness, nutritional, legal, financial, travel, or other professional advice and is not a substitute for a qualified professional. Consult an appropriate professional before activities that may affect your health or safety, particularly if you have a health condition, disability, injury, allergy, or other concern.

6. Limited license and acceptable use

Subject to these Terms, Daywild grants you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for lawful, non-commercial purposes.

You may not:

  • copy, sell, sublicense, scrape, republish, or commercially exploit the Service or mission bank except as law permits;
  • reverse engineer, interfere with, overload, probe, bypass security, or gain unauthorized access to the Service;
  • use automation to generate excessive requests or extract content;
  • upload malicious code or use the Service to harass, deceive, harm, surveil, or violate another person’s rights;
  • misrepresent your affiliation with Daywild; or
  • use the Service in violation of law, store policies, or these Terms.

7. Your content and sharing

You retain ownership of text proof, reflections, photos, voice recordings, and other content you create. You grant Daywild only the limited permission needed to receive, store, process, reproduce, and display content that is actually submitted to operate, sync, secure, and improve the Service. This permission ends when the content is deleted from active systems, subject to limited backup and legal retention described in the Privacy Policy.

Photo and voice proof files currently stay on your device and are not uploaded to Daywild. If you choose to share a completion card, you direct your device to provide that card to the destination you select. You are responsible for ensuring your content and sharing respect privacy, copyright, confidentiality, publicity, and other rights.

8. AI-assisted personalization

Daywild may use an AI provider to add an approved contextual lead-in to a human-curated mission. AI output can be inaccurate or unsuitable. The Service validates output and falls back to the approved original, but you must still use your own judgment. AI output is not professional advice and does not reduce your safety responsibilities.

9. Daywild property

The Service, Daywild name, visual design, software, mission selection system, original copy, and mission bank are owned by or licensed to Daywild and protected by applicable intellectual-property laws. These Terms do not transfer ownership or grant rights to trademarks, branding, source code, or content beyond the limited license above.

Feedback may be used to improve Daywild without restriction or compensation, provided we do not publicly identify you without permission.

10. Availability, changes, and termination

The Service may be unavailable, delayed, changed, suspended, or discontinued, including because of maintenance, hosting limits, network conditions, provider outages, abuse prevention, or legal requirements. We do not promise that any particular mission or feature will always be available.

We may restrict or terminate access when reasonably necessary to protect users, the Service, our rights, or comply with law. You may stop using Daywild at any time and remove local data through the app and operating-system controls.

11. Third-party services

App stores, operating systems, maps, transport, venues, email, sharing destinations, and other third-party services are governed by their own terms and policies. Daywild does not control or endorse them merely because the Service can open or interact with them.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Daywild disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, safety, availability, and uninterrupted or error-free operation. We do not warrant any outcome, enjoyment, benefit, venue, route, cost, or interaction resulting from a mission.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Daywild and its operator, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, opportunities, goodwill, or enjoyment; personal decisions; third-party conduct; or real-world injury, loss, or damage arising from or related to the Service.

Where liability cannot be excluded, it will be limited to the greater of the amount you paid Daywild for the Service during the twelve months before the event giving rise to the claim or the minimum amount required by applicable law. Because Daywild v1 is free, this may be zero where law permits. These limitations do not apply where prohibited, including liability that cannot lawfully be limited.

14. Responsibility for misuse

To the extent permitted by law, you agree to defend, indemnify, and hold Daywild and its operator harmless from third-party claims, damages, and reasonable costs arising from your unlawful use, your content, your violation of another person’s rights, or your material breach of these Terms. This does not require indemnification for Daywild’s own unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Before filing a claim, you agree to contact us and attempt to resolve the issue informally for at least 30 days. Subject to applicable consumer rights, courts of competent jurisdiction in India will have jurisdiction.

16. Changes to these Terms

We may update these Terms for product, legal, safety, or operational reasons. We will revise the date above and provide additional notice where required. Material changes apply prospectively. Continuing to use the Service after revised Terms take effect means you accept them; otherwise, stop using the Service.

17. General

If any provision is unenforceable, it will be modified to the minimum extent necessary and the rest will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service, subject to law. These Terms and the Privacy Policy form the agreement about the Service.
